Information on data protection regarding our processing of your personal data as a supplier of SERVOMOLD GMBH & CO. KG in accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR).

3. PURPOSES AND LEGAL BASIS OF PROCESSING


We process your personal data in accordance with the provisions of the European General Data Protection Regulation (EU GDPR) and the Federal Data Protection Act (BDSG), to the extent necessary for the establishment and execution of a business relationship with you as a supplier of our company. The legal basis is Article 6(1)(b) GDPR for the initiation or execution of contractual relationships.

Furthermore, we may process personal data from you if this is necessary to defend against asserted legal claims arising from the contractual relationship or for other reasons in our legitimate interest. The legal basis for this is Art. 6 para. 1 lit. f GDPR.

We also process your personal data as part of a legal obligation according to Art. 6 para. 1 lit. c. This is the case, for example, when we are required to process the data due to tax regulations.


4. CATEGORIES OF PERSONAL DATA


We only process data that is related to the establishment and execution of a business relationship between you as a supplier and our company.

We process the following data:

  • Company data (company name, industry, portfolio)

  • General contact information (name, first name, address, email address, telephone number, etc.)

  • Personal data (contact person, position in the company, and comparable data)

  • implemented joint measures and activities

  • Supplier history

  • Payment data, such as information used for processing payment transactions or for fraud prevention.

  • Further information that is necessary for processing within the scope of a project or the execution of a contractual relationship with us, or that is voluntarily provided by our contact persons.

  • Information collected from publicly available sources or information databases.


5. SOURCES OF DATA


The collection of your data takes place at your own premises as well as possibly from publicly available sources and information databases.

In the context of establishing and conducting a business relationship, the provision of your personal data is necessary. If the requested data is not provided by you, a business relationship cannot be established.


6. RECIPIENT OF THE DATA


We only share your personal data within our company with the departments and individuals who need it for the establishment and execution of a business relationship with you.

In addition, your personal data may be shared with cooperating partner companies of our organization in joint projects. In this case, we will obtain your consent before sharing your contact information.

Your personal data will be processed on our behalf, if necessary, based on data processing agreements according to Art. 28 GDPR. In these cases, we ensure that the processing of personal data is in compliance with the provisions of the GDPR.

Data will only be transferred to recipients outside our company if legal regulations allow or require this, if the transfer is necessary to establish and conduct a business relationship, if we have your consent, or if we are entitled to assert or defend claims.


7. TRANSFER TO A THIRD COUNTRY


A transfer to a third country is not intended.


8. DURATION OF DATA STORAGE


As far as necessary, we process and store your personal data for the duration of our business relationship, which also includes the initiation and execution of a contract.

If the data is no longer required for the fulfillment of contractual or legal obligations, it will be deleted. Unless legal obligations of the data controller speak against deletion.

If data processing is carried out in our legitimate interest, the personal data will be deleted as soon as this interest no longer exists.

In case of legal retention and documentation obligations, deletion is only considered after the respective retention period has expired. We are subject to retention obligations according to § 147 Abgabenordnung (German Fiscal Code) and § 257 HGB (German Commercial Code).


9. YOUR RIGHTS


Every data subject has the right to information according to Art. 15 GDPR, the right to rectification according to Art. 16 GDPR, the right to erasure according to Art. 17 GDPR, the right to restriction of processing according to Art. 18 GDPR, the right to notification according to Art. 19 GDPR, and the right to data portability according to Art. 20 GDPR.

Furthermore, you have the right to lodge a complaint with a data protection supervisory authority under Article 77 of the GDPR if you believe that the processing of your personal data is not lawful. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

If data processing is based on your consent, you are entitled to revoke the consent to the use of your personal data at any time in accordance with Art. 7 GDPR. Please note that the revocation only takes effect for the future. Processings that occurred before the revocation are not affected by this. Please also note that we may need to retain certain data for a specific period to fulfill legal requirements (see section 8 of this data protection information).

Right of objection

As far as the processing of your personal data is carried out in accordance with Art. 6 para. 1 lit. f GDPR to safeguard legitimate interests, you have the right, in accordance with Art. 21 GDPR, to object to the processing of this data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims. 10. AUTOMATED DECISION MAKING


There is no automated decision-making in individual cases within the meaning of Art. 22 GDPR.
