Data protection regulations for applicants

Information on data protection regarding our processing of your personal data as an applicant according to Articles 13 and 14 of the General Data Protection Regulation (GDPR).

Dear Sir or Madam,

In accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR), we hereby inform you about the processing of personal data collected about you, as well as your data protection rights in this regard. To ensure that you are fully informed about the processing of your personal data in the context of your application to our company, please take note of the following information.

3. PURPOSES AND LEGAL BASES OF PROCESSING


We process your personal data in accordance with the provisions of the European General Data Protection Regulation (EU GDPR) and the Federal Data Protection Act (BDSG), to the extent necessary for the processing and evaluation of your application with our company. The legal basis is Art. 88 GDPR in conjunction with § 26 BDSG-new for the establishment of an employment relationship, as well as possibly Art. 6 para. 1 lit. b GDPR for the initiation or performance of contractual relationships.

Furthermore, we may process personal data from you if this is necessary to defend against legal claims asserted from the application process against us. The legal basis for this is Art. 6 para. 1 lit. f GDPR. The legitimate interest is, for example, an obligation to provide evidence in the context of legal proceedings. If you grant us explicit consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR. A granted consent can be revoked at any time, with effect for the future (see section 9 of this data protection information).


4. CATEGORIES OF PERSONAL DATA


We only process data that is related to your application to our company. This may include general personal data (name, address, contact details, email address, telephone number, etc.), CV, certificates, information about your professional background, application photos, as well as any other personal data that you have provided to us as part of your application.


5. SOURCES OF DATA


The collection of your data generally takes place with you yourself. The processing of the personal data provided by you is necessary for the examination and evaluation of your application as well as, if applicable, for the establishment of an employment contract.

As part of the application process, providing your personal data is necessary. If the requested data is not provided by you, your application cannot be reviewed and evaluated.


6. RECIPIENT OF THE DATA


We only share your personal data within our company with the departments and individuals who need this data to review and evaluate your application. In particular, this includes our management, our human resources department, and the relevant department heads.

Your personal data will be processed on our behalf, if necessary, based on data processing agreements according to Art. 28 GDPR. In these cases, we ensure that the processing of personal data is in compliance with the provisions of the GDPR.

Data will only be transferred to recipients outside our company if legal regulations allow or require this, if the transfer is necessary for the processing and thus for the fulfillment of the application process, if we have your consent, or if we are entitled to assert or defend claims.


7. TRANSFER TO A THIRD COUNTRY


A transfer to a third country is not intended.


8. DURATION OF DATA STORAGE


Your data will be deleted 3 months after the completion of the application process in case your application is rejected.

In case you have consented to further storage of your personal data in accordance with Art. 6 lit a, we will include your data in our applicant pool. The data will be deleted after 12 months.

If your application leads to an employment relationship with our company as part of the selection process, your application documents will be included in your personnel file.


9. YOUR RIGHTS


Every data subject has the right to information according to Art. 15 GDPR, the right to rectification according to Art. 16 GDPR, the right to erasure according to Art. 17 GDPR, the right to restriction of processing according to Art. 18 GDPR, the right to notification according to Art. 19 GDPR, and the right to data portability according to Art. 20 GDPR.

Furthermore, you have the right to lodge a complaint with a data protection supervisory authority under Article 77 of the GDPR if you believe that the processing of your personal data is not lawful. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

If data processing is based on your consent, you have the right according to Art. 7 GDPR to revoke your consent to the use of your personal data at any time. Please note that the revocation only takes effect for the future. Processings that occurred before the revocation are not affected by this. Please also note that we may need to retain certain data for a specific period to fulfill legal requirements (see section 8 of this data protection information).

Right of objection

As far as the processing of your personal data is carried out in accordance with Art. 6 para. 1 lit. f GDPR to safeguard legitimate interests, you have the right, in accordance with Art. 21 GDPR, to object to the processing of this data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims. 10. AUTOMATED DECISION MAKING


There is no automated decision-making in individual cases within the meaning of Art. 22 GDPR.

You also have the right to contact our data protection officer at any time, who is obliged to maintain confidentiality regarding your inquiry. You can find the contact details on page 1 under point 2.
